Terms of Service

1. Scope

These Terms of Service govern your use of Whisperflow, a macOS voice typing application developed by Kai Detmers ("we", "us"). By downloading, installing, or using Whisperflow, you agree to these terms.

2. Our Services

Whisperflow provides:

• On-device voice typing — Push-to-hold dictation using Whisper.cpp, processed entirely on your Mac.
• AI text actions — Optional cloud features including email replies, web search, screen actions, and custom prompts via Anthropic's Claude API.
• Notch UI — A native macOS overlay integrated into the MacBook notch area.

3. Subscription & Pricing

Core dictation features are included with any subscription. AI features require an active subscription plan:

• Monthly: $9.99/month
• Annual: $79.99/year

Subscriptions are managed through our payment provider (Stripe). You can cancel at any time. Refunds are handled according to the applicable consumer protection laws.

4. User Account

You may create an account via Google Sign-In. You are responsible for maintaining the security of your account credentials. Notify us immediately at t3mr0i@gmail.com if you suspect unauthorized access.

5. Acceptable Use

You may use Whisperflow for personal and professional purposes. You may not:

• Reverse-engineer, decompile, or disassemble the application (beyond what applicable law permits).
• Use the AI features to generate content that violates Anthropic's Acceptable Use Policy.
• Redistribute or resell the application or subscription access.
• Attempt to circumvent subscription or licensing mechanisms.

6. Permissions

Whisperflow requires macOS permissions to function:

• Microphone — Required for voice recording. Active only while you hold the hotkey.
• Accessibility — Required to insert transcribed text into other applications.
• Screen Recording — Optional. Required only for AI screen actions (Computer Use).

7. Third-Party Services

AI features use Anthropic's Claude API. By enabling these features, you also agree to Anthropic's terms. We use Firebase for authentication and Stripe for payment processing.

8. Availability

We strive for high availability but cannot guarantee uninterrupted service. The app may be unavailable during maintenance, updates, or third-party API outages. On-device dictation works independently of our servers.

9. Limitation of Liability

To the extent permitted by law, our liability is limited to intentional misconduct and gross negligence. We are not liable for:

• Inaccuracies in transcription or AI-generated text.
• Actions taken based on AI suggestions or screen actions.
• Data loss or technical issues on your device.
• Indirect or consequential damages.

You are solely responsible for reviewing AI-generated content before use.

10. Intellectual Property

Whisperflow and its original content are protected by copyright. The source code is available on GitHub under its respective license. Whisper.cpp is licensed under MIT. Third-party components retain their original licenses.

11. Termination

You may stop using Whisperflow at any time by uninstalling the application and canceling your subscription. We may terminate your access for violation of these terms, after prior notice where feasible. Account data is deleted within 30 days of termination.

12. Governing Law

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Frankfurt am Main, Germany.

13. Changes

We may update these terms. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
